General Terms and Conditions of Delivery and Payment for Online Orders

§ 1 Scope

These terms apply to contracts for the supply of goods concluded between an entrepreneur and a consumer exclusively through means of distance communication (telephone calls, faxes, emails, etc.), unless the contract is not concluded within the framework of a distance sales or service system.

§ 2 Right of Withdrawal for Consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Kilic Feintechnik GmbH, represented by managing director Michael Ali Kilic, Heidenfelder Straße 1, 97525 Schwebheim, Germany, telephone: +49 9723 93805-0, fax: +49 9723 93805-129, email: kilic@mak.ag) by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

Consequences of withdrawal

If you withdraw from this contract, we will refund you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract.

§ 3 Prices, Price Changes

Prices are cash payment prices including statutory VAT, plus a flat-rate shipping and packaging fee. Shipping costs depend on the dimensions and weight of the delivery and the prices of the shipping company UPS.

If more than 6 months lie between contract conclusion and the agreed and/or actual delivery date, the seller's prices valid at the time of delivery or provision apply. If the latter prices exceed the originally agreed prices by more than 10%, the buyer has the right to withdraw from the contract.

§ 4 Delivery Time

Agreements on delivery dates or deadlines require written form.

§ 5 Claims for Defects

If the delivered item is defective or lacks the agreed quality, the buyer may choose between rectification or replacement (subsequent performance). The seller bears the necessary expenses for subsequent performance.

The warranty period is 2 years and begins with the delivery of the item. If the delivered item is a used item, the warranty period is 1 year from the time of delivery.

§ 7 Reservation of Title

Until all claims the seller is entitled to against the buyer for any legal reason, now or in the future, have been fulfilled, the seller reserves title to the delivered goods (reserved goods).

The buyer may not dispose of the reserved goods. In the event of third-party access, in particular by bailiffs, to the reserved goods, the buyer shall point out the seller's ownership and notify the seller immediately.

§ 8 Payment

"The buyer generally consents to electronic invoicing to the email address provided by them." Seller invoices are generally due for payment immediately upon handover of the purchased item — no later than 14 days after invoicing.

The buyer is only entitled to offset if the counterclaim is undisputed or has been legally established.

§ 9 Purchase of Weapons, Ammunition, Powder

Weapons and ammunition requiring a purchase license will only be sold or delivered upon presentation of valid documents: e.g. hunting license in original or, as appropriate, as official confirmation or officially certified photocopies of all inscribed pages (fax must not be accepted), firearms ownership card in original, ammunition purchase license in original or special permit in original.

Items not requiring a purchase license will only be delivered or sold upon presentation of an official original document or, as appropriate, upon presentation of an official confirmation that the purchaser has completed the 18th year of age. Powder may only be purchased upon presentation of the original explosives permit.

§ 10 New Customers

For the first order, delivery is made against advance payment, thereafter by invoice.

§ 11 Alternative Dispute Resolution

1. The EU Commission provides an online dispute resolution platform on the Internet at the following link: http://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

2. The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration body.
